If you’re in the early stages of a divorce and you haven’t hired a lawyer yet – but you found out your ex has, don’t panic!
Take a deep breath, and don’t let fear call the shots.
A Lawyer On the Other Side is Helpful, not Harmful
Getting a lawyer just means they’re represented.
That’s it.
People get lawyers for all kinds of reasons: to understand their rights, to get help with paperwork, to make sure nothing gets missed. It doesn’t automatically mean they’re coming after you, or trying to take you to the cleaners.
In fact, a good lawyer often helps keep things calm, not escalate them.
Consult an Attorney
If you are a little anxious, it is probably good time to schedule a one-on-one consultation with an attorney.
Be wary of free consultations.
If you’re able to hire a lawyer, look for one who will guide you with wisdom and discernment, not one who pushes for conflict.
A good attorney explains the law clearly, focuses on your goals, and works toward a fair resolution.
Avoid those who seem eager to escalate disputes – the “pitbulls”.
A calm, knowledgeable lawyer on your side, if you choose to hire one, can level the playing field without turning things into a battle.
You Have Rights and Options
If you opt not to retain an attorney, you still have rights.
Being unrepresented doesn’t mean you’re powerless. The law applies to both of you the same way.
You don’t need a law degree to understand your rights. Take time to learn about divorce laws in your state or country – topics like asset division, alimony, or child custody. Knowing what the law says and what’s at stake – whether it’s your finances or time with your children – empowers you to make informed decisions.
Not All Divorce Lawyers are Weapons of Mass Destruction
TV and bad divorce stories have convinced people that all divorce lawyers are vampires out to suck blood.
In reality, most seasoned family law attorneys are not that way. Many are collaborative, and experienced at resolving bad situations.
So don’t assume the other side’s lawyer is a weapon of mass destruction, out to destroy you. Chances are, they’re just doing their job.
And if they’re doing it well, they’re probably hoping to reach a fair outcome without a fight.
