Britney Spears is Divorcing Sam Asghari

Britney Spears is getting divorced.  This time, she was only married for 14 months.

As usual, I was summoned by media outlets to answer their pressing questions about family law.

14 month Marriage

Sam Asghari is the Petitioner.  He lists July 28, 2023 as the date of separation.  According to TMZ, Sam believed Britney was cheating on him with the house staff member.

Is Britney’s Prenuptial Agreement Enforceable?

According to tabloid news, Sam’s attorney (Neal Hersh) is getting ready to challenge the prenup.

Question is: Will he succeed?

Answer: that depends.

Most people foolishly think that prenups are iron-clad or bullet proof. As I explained in this blog post, no lawyer can ever guarantee you a bullet-proof prenup.  The best you can get is bullet-resistant.

Yes, prenuptial agreements are sometimes successfully challenged. Which means there is a risk for failure. But you know what else sometimes fails?

Parachutes, birth control, and bullet-proof vests.

It’s STILL better to wear a parachute when you skydive, wear a condom if you are not ready to parent, and wear a bullet-proof vest if bullets come flying at you.

All prenups are challenge-able

Just because you have an ironclad contract, does not mean that the other side can’t just harass you with a lawsuit to challenge it.

This happens a lot in celebrity cases.  I suspect it happened in Kelly Clarkson’s case, as well as Tom Cruise’s divorce case.

By virtue of the marriage, the spouse learns private things that they hold as hostage against the celebrity so the prenup isn’t enforced.

Nevertheless, It’s Still Better to Have One than Not

If you are a celebrity, it is more likely that your marriage will fail than succeed.

Prenups hold water.  Make sure you get one.
