Conflicting Out Attorneys in Divorce
Today, our topic of discussion is a sadly all too common practice in divorce proceedings – conflicting out attorneys. The usual dirty trick.
Conflicting Out Attorneys
In simple terms, an individual can ‘conflict out’ an attorney by meeting with them and discussing their divorce case in detail. This triggers the duty of confidentiality, and binds the attorney with client-attorney privilege so that the individual’s spouse is not able to hire them.
This dirty trick is unfortunately often used by individuals looking out for revenge during their divorce proceedings. They will go around to all of the top divorce attorneys in town and have a meeting with each one, effectively making it impossible for their ex to hire said attorney.
Make it Impossible for the Other Side to Hire Good Representation
This tactic can make it difficult for someone going through a divorce to find proper representation.
What to Do if Your Ex Is Conflicting out Attorneys
If you think that your spouse may be trying to conflicting out attorneys, it is important that you seek legal help immediately. Don’t wait until they’ve gotten to every divorce lawyer in town. (Not quite as much of a problem in Los Angeles as it is in a small town elsewhere).
To Prevent This, We Charge for Consults
We are well aware of this trick and thus do not just “take calls”. All consults are properly scheduled after conflicts checks, and we do not offer free consultations.
