In simple terms, an individual can ‘conflict out’ an attorney by meeting with them and discussing their divorce case in detail.  This triggers the duty of confidentiality, and binds the attorney with client-attorney privilege so that the individual’s spouse is not able to hire them.

This dirty trick is unfortunately often used by individuals looking out for revenge during their divorce proceedings. They will go around to all of the top divorce attorneys in town and have a meeting with each one, effectively making it impossible for their ex to hire said attorney.

This tactic can make it difficult for someone going through a divorce to find proper representation.

What to Do if Your Ex Is Conflicting out Attorneys
