Eviction Fees

UNCONTESTED EVICTION
(Approximately 75% of all cases filed)

Law and Mediation Offices of Kelly Chang charges a minimum retainer fee of $750 to process a typical residential default eviction. This is only attorneys’ fees, and does NOT cover costs (court filing fees of $435; service of process fees for up to two defendants; fees for the Sheriff to serve the Writ of Possession and the fees for the Writ of Possession itself.) ***

*** Rule 4-210 of the Rules of Professional Conduct requires lawyers to pass costs to clients.

The $750 includes the following services:
  1. Initial telephone conference or in-person interview;
  2. Review of any relevant correspondence to determine legal strategy;
  3. Preparation of appropriate “Notice to Quit”;
  4. Drafting of Summons & Complaint for Unlawful Detainer;
  5. Filing of Summons & Complaint for Unlawful Detainer;
  6. Filing and serving Prejudgment Claim;
  7. Service of papers on Defendant(s);
  8. Mailing of “Notice of Service” from the process serving company
  9. Review of “Proof of Service”;
  10. Drafting of Default Papers (Request to Enter Default; Writ of Restitution; Clerk’s Judgment for Restitution; Instructions to Sheriff);
  11. Filing of Default Papers.
CONTESTED EVICTION

Law and Mediation Offices of Kelly Chang will charge an additional fee of $2500 if the tenant answers the Summons & Complaint, or files opposing papers.

The $2500 will cover the additional services:

  1. Obtaining and reviewing Tenant’s response;
  2. Preparation and filing of a Request to Set Civil Case and Notice of Time and Place of Trial;
  3. Conference with client to prepare for trial;
  4. Trial of case;
  5. After trial, preparation of Judgment, Memorandum of Costs, and Writ of Possession/lnstructions to Sheriff;
  6. Delivery of the Writ of possession to the Sheriff’s Office.
Potential Services Which Are Not Covered:

Depending on how the tenant responds, or if they request a JURY TRIAL, there may be other services and costs. If so, we charge at our normal hourly rate, with a minimum retainer of $5,000.
